{"id":80,"date":"2020-03-02T21:30:27","date_gmt":"2020-03-02T21:30:27","guid":{"rendered":"https:\/\/arborsbarsandmore.com\/?page_id=80"},"modified":"2020-06-12T12:13:18","modified_gmt":"2020-06-12T12:13:18","slug":"rental-agreement","status":"publish","type":"page","link":"https:\/\/arborsbarsandmore.com\/?page_id=80","title":{"rendered":"Rental Agreement"},"content":{"rendered":"\t\t<div data-elementor-type=\"wp-page\" data-elementor-id=\"80\" class=\"elementor elementor-80\" data-elementor-settings=\"[]\">\n\t\t\t<div class=\"elementor-inner\">\n\t\t\t\t<div class=\"elementor-section-wrap\">\n\t\t\t\t\t\t\t<section class=\"elementor-element elementor-element-79466f51 elementor-section-boxed elementor-section-height-default elementor-section-height-default elementor-section elementor-top-section\" data-id=\"79466f51\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t<div class=\"elementor-row\">\n\t\t\t\t<div class=\"elementor-element elementor-element-4e409224 elementor-column elementor-col-100 elementor-top-column\" data-id=\"4e409224\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-column-wrap  elementor-element-populated\">\n\t\t\t\t\t<div class=\"elementor-widget-wrap\">\n\t\t\t\t<div class=\"elementor-element elementor-element-170e1ca2 elementor-widget elementor-widget-text-editor\" data-id=\"170e1ca2\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div class=\"elementor-text-editor elementor-clearfix\"><!-- wp:paragraph -->\n<p>RENTAL AGREEMENT<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><strong>For the purpose of this Rental Agreement:<\/strong><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:list -->\n<ul><li>Arbors, Bars and\n     More (ABM) shall mean the Rental Company, its owners, officers, directors,\n     and employees.<\/li><li>Customer(s)\n     shall mean Customers, guests\/visitors of customer, and their agents, contractors\n     and\/or employees.<\/li><li>Rental Agreement\n     shall mean the itemized list of items contained in the electronic estimate\n     or invoice emailed or faxed to the Customer, who by virtue of having\n     signed the estimate or invoice, and\/or paid an advance deposit or in full,\n     expresses his or her agreement with the contents of the Estimate or\n     Invoice.<\/li><\/ul>\n<!-- \/wp:list -->\n\n<!-- wp:paragraph -->\n<p><strong>In reference to leasing the rental item(s) \/ equipment described\non the Rental Agreement, it is agreed as follows:<\/strong><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:list {\"ordered\":true} -->\n<ol><li><strong>INDEMNITY\/HOLD\n     HARMLESS.<\/strong><\/li><\/ol>\n<!-- \/wp:list -->\n\n<!-- wp:paragraph -->\n<p>Customer will take all necessary precautions regarding the items\nrented and protect all persons and property from injury or damage.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Customer agrees to hold Arbors Bars and More harmless from and\nagainst any and all liability, claims, judgments, attorneys\u2019 fees and costs of\nevery kind and nature, including, but not limited to, injuries or death to\npersons and damage of property, arising out of the use, maintenance\u2013\ninstallation, operation, possession, ownership, or rental of the items rented,\ndespite cause.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:list {\"ordered\":true} -->\n<ol><li><strong>ASSUMPTION OF\n     RISK\/RELEASE DISCHARGE OF LIABILITY.<\/strong><\/li><\/ol>\n<!-- \/wp:list -->\n\n<!-- wp:paragraph -->\n<p>Customer is fully aware of and acknowledges that there is a risk\nof injury, death, or damage arising out of the use or operation of the items\ncontained in the Rental Agreement and hereby elects to voluntarily enter into\nthis Agreement and assume all of the aforementioned risks.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Customer agrees to release and discharge Arbors Bars and More\nfrom any and all responsibility or liability from such injury, death, or damage\narising out of the use or operation of the rental items. Customer further\nagrees to waive, release and discharge any and all claims for injury, death, or\ndamage against Arbors Bars and More, which customer otherwise may be entitled\nto assert.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:list {\"ordered\":true} -->\n<ol><li><strong>POSSESSION\/\n     TITLE.<\/strong><\/li><\/ol>\n<!-- \/wp:list -->\n\n<!-- wp:paragraph -->\n<p>Arbors Bars and More agrees to reserve all items listed in the\nRental Agreement on behalf of the Customer only after the following have been\nreceived from the customer.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:list -->\n<ul><li>A non-refundable\n     deposit equal to 50% of the total cost specified in the Rental Agreement\n     (or a lesser amount determined at the sole discretion of ABM)<\/li><li>A signed &amp;\n     dated copy of these Terms and Conditions; and<\/li><li>A signed &amp;\n     dated rental agreement.<\/li><\/ul>\n<!-- \/wp:list -->\n\n<!-- wp:paragraph -->\n<p>The remaining balance of the rental agreement must be paid 31\ndays prior to delivery, unless otherwise specified by ABM. If this obligation\nis not met, ABM reserves the right to either cancel the order without refunding\nthe initial 50% deposit or apply late payment charges equal to the highest APR\nallowed by New Jersey law.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Customer\u2019s right to possession of the rental items:<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:list -->\n<ul><li>Is for a 1-day\n     period. Equipment will be picked up on same day as installed.<\/li><li>In the absence\n     of the renter, the equipment may be signed for by an individual designated\n     by the renter. This individual is automatically given the legal right by\n     the renter to accept liability for the equipment on the renter\u2019s behalf.<\/li><li>The rental\n     agreement terminates once Arbors Bars and More has regained possession of\n     the rental equipment.<\/li><li>Any extension of\n     the agreement must be agreed upon by ABM in writing.<\/li><li>Title of the\n     rental items shall, at all times, remain with ABM.<\/li><li>Customer\n     authorizes ABM to retake possession of the rental items without notice or\n     legal process at any time, despite whether the equipment is on private\n     property.<\/li><\/ul>\n<!-- \/wp:list -->\n\n<!-- wp:list {\"ordered\":true} -->\n<ol><li><strong>LEGAL FEES.<\/strong><\/li><\/ol>\n<!-- \/wp:list -->\n\n<!-- wp:paragraph -->\n<p>Customer will pay all collection fees, attorney\u2019s fees, court\ncosts, or any other expenses required to enforce the items and conditions of\nthis contract. Any lawsuits that may occur between ABM and their customers must\nbe filed in Hunterdon County, and any litigation will be held in a Hunterdon\nCounty Court.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:list {\"ordered\":true} -->\n<ol><li><strong>MISCELLANEOUS.<\/strong><\/li><\/ol>\n<!-- \/wp:list -->\n\n<!-- wp:paragraph -->\n<p>The Rental Agreement may be executed or delivered by fax, or\nother electronic means such as email. The Rental Agreement is valid whether\nproperly signed by the Customer or not, so long as the Customer takes\npossession of the rental items. It is also valid if signed by another party\nsigning on behalf of the Customer, in which case the signing party will sign\ntheir own name, and then print C\/O (Care Of) \u201cOrdering Party.\u201d<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:list {\"ordered\":true} -->\n<ol><li><strong>UNSAFE\n     CONDITIONS.<\/strong><\/li><\/ol>\n<!-- \/wp:list -->\n\n<!-- wp:paragraph -->\n<p>Arbors Bars and More reserves the right to refuse to install or\ndeliver rental equipment due to unsafe conditions or weather. If this occurs,\nCustomer will be liable for a minimum of 50% of the total cost specified in the\nRental Agreement. In the absence of unsafe weather or other conditions, Arbors\nBars and More will use all aABMopriate means and methods to secure the rental\nequipment for the safety of the Customer and the equipment.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Arbors Bars and More is not responsible for underground\nutilities, and charges for time out, whether equipment is used or not. If\npermission is granted by the Customer to stake anything into the ground at\ntheir desired location, then it is the sole responsibility of the Customer to\ncheck for underground utilities and water mains.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:list {\"ordered\":true} -->\n<ol><li><strong>CANCELLATIONS.<\/strong><\/li><\/ol>\n<!-- \/wp:list -->\n\n<!-- wp:paragraph -->\n<p>All customers will provide a 50% NONREFUNDABLE DEPOSIT in order\nfor ABM to reserve their order.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:list -->\n<ul><li>Customers who\n     cancel their orders at any time after a deposit is provided WILL LOSE\n     THEIR DEPOSIT regardless of their circumstances or reasons for\n     cancellation.<\/li><li>Adjustments to\n     orders can be made until 30 days prior to delivery (except for specialty\n     items \u2013 see below). However, any such adjustments shall not reduce the\n     total price of the invoice below the amount of the NON-REFUNDABLE 50%\n     DEPOSIT.<\/li><\/ul>\n<!-- \/wp:list -->\n\n<!-- wp:list {\"ordered\":true} -->\n<ol><li><strong>INSTALLATIONS<\/strong><\/li><\/ol>\n<!-- \/wp:list -->\n\n<!-- wp:list -->\n<ul><li>ABM will reserve\n     dates for rental orders only if a rental agreement and this document have\n     been signed. No Refunds for any order canceled 31 days prior to event. The\n     50% deposit is not refundable after 3 business days from placement of\n     order.<\/li><li>Responsibility for\n     insurance and issues with a venue are solely the customers responsibility.<\/li><li>The Customer is responsible\n     for providing on-site contact information, as well as contact information\n     from any other party to ABM in regards to the rental installation. This\n     information will be provided at least 31 days prior to the event. ABM will\n     not be responsible for issues arising from being provided wrong\n     information. <\/li><li>Customer will be\n     responsible for any damage done to the rentals.<\/li><\/ul>\n<!-- \/wp:list -->\n\n<!-- wp:list {\"ordered\":true} -->\n<ol><li><strong>DELIVERY\n     CHARGES.<\/strong><\/li><\/ol>\n<!-- \/wp:list -->\n\n<!-- wp:list -->\n<ul><li>Minimum delivery\n     charges are based on 1-4 hour delivery windows with \u201cnon-same-day\u201d\n     pickups. Same-day and\/or late evening pickups can be arranged for\n     additional charges.<\/li><li>Customers must\n     be present for their entire delivery window. PER will grant a 15 minute\n     waiting period, after which the customer will be charged for waiting time\n     up to $120.00 per hour billed in 5 minute increments.<\/li><li>Orders will be\n     delivered only if the cost of the items rented, excluding delivery fees\n     and labor, is at least $250.<\/li><li>ABM offers\n     setup\/breakdown services of equipment for additional charges.<\/li><li>\u201cCurbside\n     delivery,\u201d is defined as:<\/li><\/ul>\n<!-- \/wp:list -->\n\n<!-- wp:list {\"ordered\":true} -->\n<ol><li>Delivery to a\n     ground level location on a flat, hard surface, within twenty five (25) feet\n     of the nearest loading area with no steps or obstructions.<\/li><li>All equipment\n     must be left where it was installed and only ABM will move the equipment. <\/li><li>There will be a\n     minimum two hour window for both delivery and pickup (unless otherwise\n     arranged in writing with ABM).<\/li><\/ol>\n<!-- \/wp:list -->\n\n<!-- wp:paragraph -->\n<p>ABM may assess additional charges at a rate of up to $120 per\nhour when delivery conditions cause ABM to incur additional labor costs,\nincluding, but not limited to:<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:list -->\n<ul><li>deliveries\n     impeded by stairs, elevators, steep or uneven surfaces, standing water,\n     mud, or soft surfaces like sand, loose gravel, surfaces that are more than\n     4\u201d out of level.<\/li><li>deliveries that\n     involve waiting times of more than 15 minutes;<\/li><li>customer\n     requires a precise (to within 15 minutes) delivery or pickup time;<\/li><li>last-minute or\n     rush deliveries or pickups; and\/or<\/li><li>Inaccurate\n     delivery locations or directions supplied by the Customer.<\/li><li>If the renter is not available, then ABM may opt to\n     either setup in a manner deemed aABMopriate by our staff. In such\n     instances, no refunds will be given, and the customer accepts liability\n     for any losses and damages that may happen to equipment left unsupervised\n     for any reason, including acts of God.<\/li><\/ul>\n<!-- \/wp:list -->\n\n<!-- wp:list {\"ordered\":true} -->\n<ol><li>&nbsp;<\/li><li><strong>EQUIPMENT USAGE\n     AND RETURN.<\/strong><\/li><\/ol>\n<!-- \/wp:list -->\n\n<!-- wp:paragraph -->\n<p>Customer is responsible for any loss or damage to rental items\nregardless of cause or fault, including acts of God, and ABM has 72 hours after\nretaking or receiving possession of rented merchandise to assess its condition\nand determine whether damage occurred while it was in the possession of the\nrenter.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>In such instances, unless the items in question are covered by a\ndamage waiver, the Customer agrees to pay ABM for:<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:list -->\n<ul><li>All labor costs\n     associated with repair and\/or attempted repair of damaged equipment<\/li><li>Replacement\n     equipment (if necessary)<\/li><li>Replacement of\n     equipment directly related to the normal quality and functionality of the\n     damaged equipment<\/li><li>All shipping or\n     delivery fees associated with the replacement or repair of damaged\n     equipment.<\/li><\/ul>\n<!-- \/wp:list -->\n\n<!-- wp:list {\"ordered\":true} -->\n<ol><li><strong>DAMAGE WAIVER.<\/strong><\/li><\/ol>\n<!-- \/wp:list -->\n\n<!-- wp:paragraph -->\n<p>An 8% charge will be applied to all rental items to cover the\ncost of normal cleaning and maintenance. This does not cover LOSSES, THEFT OR\nDISAPPEARANCE OF EQUIPMENT<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>DUE TO CUSTOMER NEGLIGENCE. Broken items must be returned in\ntheir broken state or they will be considered stolen. Replacement of lost or\ndamaged items is chargeable in addition to the damage waiver charge.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:list {\"ordered\":true} -->\n<ol><li><strong>MEASURING EVENT\n     AREA.<\/strong><\/li><\/ol>\n<!-- \/wp:list -->\n\n<!-- wp:list -->\n<ul><li>ABM provides\n     on-site estimates whenever possible for a fee of at least $125.<\/li><li>Planning and\n     measuring is ultimately the responsibility of the Customer. If poor\n     planning leads to improperly measured areas for placement of canopies, bars,\n     etc. resulting in our inability to complete a job, then no refunds will be\n     given and full payment will be made to ABM by the Customer.<\/li><li>ABM will not be\n     held liable for any planning not performed by our staff.<\/li><li>The Customer is\n     responsible for locating and pointing out any underground utilities, such\n     as water mains, and gas, electrical, and sewage lines.<\/li><\/ul>\n<!-- \/wp:list -->\n\n<!-- wp:list {\"ordered\":true} -->\n<ol><li><strong>DISCOUNTS.<\/strong><\/li><\/ol>\n<!-- \/wp:list -->\n\n<!-- wp:paragraph -->\n<p>ABM may offer discounts at its sole discretion. Any violation by\nthe customer of ABM\u2019s rental contract or Terms and Conditions, including\nviolation of payment terms, will make such discounts null and void.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:list {\"ordered\":true} -->\n<ol><li><strong>LOCAL RULES AND\n     REGULATIONS.<\/strong><\/li><\/ol>\n<!-- \/wp:list -->\n\n<!-- wp:paragraph -->\n<p>Any and all rules and regulations governing an event site must\nbe provided in writing to ABM prior to the delivery of rental equipment.
